Gun Control US Style

Its been little reported but the US is actually going through one of its periodic, but ineffectual attempts at gun control.

The bear in the woods is the US constitution (as well as the various US state constitutions, where 44 states have constitutional provisions that protect the right to individual gun ownership), which gun owners claim, supports their right to own guns. The Second Amendment which was added in 1791, states: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

Now to a European, or an non jurist US citizen, this appears to be simply a law to ensure that US states can set up armed militia's i.e. Armies, and not a call to allow individuals to own semi automatic rifles etc. However US lawyers soon ensured that this is exactly what this amendment has come to mean, and this has remained the case ever since.

Now this has been much debated in the world at large, but oddly not in the US, where the Second Amendment has in fact not been debated in the US Supreme Court since since 1939 (and did not directly address whether the amendment protects individual as opposed to collective rights). There is a case, District of Columbia vs Heller, which is due to come to the Supreme Court this year, in which the meaning of the Second Amendment may be determined again.

Now if the DC ban on hand guns is overturned, then there will be no change in the reality of the current situation, (except, black murder rates in Washington may go up a few dozen), but if the Supreme Court upholds the gun ban in DC as not being against the 2nd Amendment, then the way is open for a larger challenge to the individuals rights to bear arms, except as part of a state organised militia.

Only in the US would this ever have arisen, as its quite obvious what the 2nd Amendment is intended to allow, but in such a litigious country, the commas and fullstops of someone in 1791, when English grammar was still not fully made fast (The Samuel Johnson Dictionary of the English Language & Grammar was published in 1755), have been pored over by jurists ever since, and what was plain language, has been distorted to the point, where this sentence has come to support a raft of legislation.

It will be interesting to see if the US love affair with private weapons has weakened even slightly.

Just for the record surveys suggest that there are now 90 guns for every 100 citizens in the US, making it the most heavily-armed nation in the world and according to reports India is the second with an estimated 46 million firearms outside law-enforcement agencies and the military (at four guns per 100 people) and China third, with 40 million privately held guns, (at 3 firearms per 100 people).

On a purely per capita basis, Yemen has the second most heavily armed citizenry behind the United States, with 61 guns per 100 people, followed by Finland with 56, Switzerland with 46 (all males are part of the army), Iraq with 39, and Serbia with at 38 are also high figures.

With 30 guns per 100, France, Canada, Sweden, Austria and Germany are next. Pakistan has 12 per 100 people and Afghanistan is estimated to be about 40 per 100, but Nigeria, which is perceived as a violent country, officially has just one gun per 100 people.

The world is a strange place.

This time at a school in the state of Michigan, by fifteen year old student Ethan Crumbley, leaving four fellow students dead, and seven others injured, including a teacher. Crumbley's parents were also arrested and charged with involuntary manslaughter.

Just Shooting The Breeze

The United States has had 146 mass shootings (four or more people dead), between 1966 and 2017 .... So is it because American society is unusually violent? Perhaps its citizens lack proper mental care under a failed mental health care system that the poor can't access?

Student Massacre in Virginia Tech University

The news is just coming through of a student massacre in Virginia Tech University in Virginia, US. The full facts are not yet known, but it appears that there may well have been two separate shooting incidents on the faculty within hours of each other, and a death toll in excess of 31, plus wounded. It appears to have been the work of one man, who had 'emotional' issues.

Firstly: My commiserations to any family, or friends of the dead, or injured who may stumble across this blog. It’s both a national and personal tragedy on a scale that it’s hard for the unaffected to imagine. Coming as it did on the 8th anniversary of the Columbine High School massacre in Colorado (surely no coincidence), it’s a particularly vivid reminder of the darker side to the American dream.

US Political Schizophrenia

What a strange set of values the US politicians seem to hold ...

For the second time in months, the US House of Representatives has passed a controversial 'Cyber Information Sharing and Protection Act' (Cispa) which is designed to help combat cyber threats from other countries and criminal hackers, by making it easier for law enforcers to get at web data.

"If you want to take a shot across China's bow, this is the answer," said the Republican politician who both co-wrote Cispa and chairs the House Intelligence Committee.

On the other side of the argument, the 'American Civil Liberties Union', along with prominent members of the US Senate have opposed Cispa, saying the bill was "fatally flawed", or too intrusive. President Obama has threatened to veto it if he's not satisfied it offers only the minimum amount of data for investigations.

In the same week in US Politics - President Barack Obama has forcefully criticised the US Senators who blocked a bipartisan plan to support expanded background checks on firearms. The proposal, put forward as an amendment to a broader gun bill, sought to widen the current checks to include on-line and unlicensed gun show dealers.

"This was a pretty shameful day for Washington", Mr Obama said at the White House.

So basically this political schizophrenia has meant the right to own and sell guns has been defended by US Senators, over the right to live in a little more safety (NB: it was a pretty tame proposal to control gun sales after all - it didn't even affect sales in 'families' and to 'friends' - so could be bypassed easily!).

While the right to freedom from intrusive law enforcement agencies has been threatened with erosion by US Representatives and defended by the President.

The 'Land of the Free and the Home of the Brave', can be very confusing at times, even to its friends.

.... at least 18 dead (and possibly more), and an unconfirmed number of injured (but at least 13), as yet again some malcontent decides to grab 15 minutes of infamy, and goes on a killing spree. The state (which is the whitest in the USA), had only had 29 homicides in 2022, so he's likely nearly matched that in a few hours.

Wacko Waco

I am not saying that the inhabitants of the great state of Texas are just little bit to the right of Attila the Hun, but, when the Republican State Governor Greg Abbott issued a directive instructing the Texas State Guard to monitor forthcoming Federal military exercises, operation name 'Jade Helm 15', which are scheduled to begin in Texas in July, it brought a new meaning to the 'Watch the Feds' paranoia of the 'T Party' ideology.

Apparently these impending exercises drew concerns from certain political groups in the Republican Party, namely that the Federal government could be about to implement martial law, or confiscate citizens guns, both 'no no's' in the far right groups world. These fantastical ideas swept social media and apparently spooked the governor .... although why the Feds should be thought to be contemplating these unconstitutional actions I don't know.

Just Another Little Gun Incident

A six-year-old African-American boy has shot Abigail Zwerner, a teacher at Richneck Elementary School, with a hand gun in the town of Newport News in the US state of Virginia last Friday ......

.... in what police confirmed was not "an accidental shooting", while the teacher was giving a lesson. There was no confrontation between the boy and teacher who was left with life-threatening injuries but who bravely escorted all of her other students out of the classroom after she was shot.
