.... has been awarded $7,500 from the county to settle a jail treatment lawsuit.
Yep to add insult to injury, Smiley Martin, 27, who faces charges of being in possession of a machine gun, and who was injured in the Sacramento shoot-out, and so he initially required medical treatments when arrested, but once these were completed was transferred to Sacramento County Main Jail, has sued for his rights being broken.
The $7,500 was awarded to Martin (who has a long criminal record, and is an 'alleged' gang member), for an earlier period in Sacramento County Jail. Martin was in the jail in 2018, and on his way to the state prison to serve time on an assault charge, when he alleged — in a lawsuit he filed pro se, meaning he represented himself — that a jail guard allowed rival gang members to attack him by releasing rival gang members for breakfast at the same time as him (against jail policy). Martin said he was surrounded by enemies who attacked him, throwing hot water on him and giving him a second-degree burn on his hip ... aww didums, did the big brave gang member get a red stingy mark?
He then claimed that the guard also threatened him when he filed a complaint about it. A county spokesperson said that “the county’s decision to settle [out of court] was purely an economic decision” and should not be understood as an indication that officials thought Martin’s claims had merit.
What this actually illustrates is that in the claims culture that lawyers have created, its often cheaper to make a no liability settlement, rather than contest false and malicious claims ... this practise is so wrong that its threat to justice. Maybe if claims are made and lost, then the lawyers are made to have to pay costs and compensation, not less than the amount being falsely claimed then this practise might cease.
NB: Mtula Payton is the third suspect, along with brothers Smiley and Dandrae Martin to be arraigned on several murder charges.
