Is Democracy In The US Dying?

It's a question that has to be asked ....

 ... not just because of President Trump's authoritarian approach to the Presidency. Nor the vengeful sackings and prosecutions of Civil Servants, apparently for just doing their jobs, ranging from Capitol Hill police officers, Justice Department lawyers continuing to sackings such as the recent sacking of Bureau of Labour Statistics Commissioner Erika McEntarfer for bringing bad news.

No, the reason why this question might be asked goes back to a 5-4 ruling by the Supreme Court way back in 2019 that declared that federal judges could not review extreme partisan gerrymandering of electoral boundaries to determine if they violated constitutional rights.

Previously, federal judges had been able to stop electoral boundaries from being redrawn to favour one section of the electorate over another. The dissenting 4 judges stated that nothing "... is more important than free and fair elections.”

Chief justice Roberts admitted in the majority ruling at the time that “Excessive partisanship in districting leads to results that reasonably seem unjust", but added that “the fact that such gerrymandering is ‘incompatible with democratic principles,’ … does not mean that the solution lies with the federal judiciary.”

But the effect of this ruling was that there is no one standard across the US for what constitutes "extreme partisan gerrymandering," indeed it even apparently allows for race and religion to be constituent factors in where boundaries are drawn or seats merged,

And that's the key to why we can question, if US Democracy may be under threat ... for instance, in the UK, the electoral commission has no political input and doesn't draw boundaries based upon voting patterns, but just on trying to keep voting numbers per MP as even as possible nationally (or so we are told)

But since that Supreme Court ruling, both Democrat and Republican states where no independent authority performs the task, have started or already redrawn boundaries (called redistricting in the US), based upon voting patterns etc to strengthen their own votes and candidates inside these states. Indeed Democrat states that handle their own redistricting such as Illinois, New Mexico and Nevada, have already manipulated electoral boundaries for partisan gain just as Republicans have.

The latest and perhaps most blatant of these actions is proposed in Texas, where Republican politicians are planning to carry out a case of extreme partisan gerrymandering by proposing a new boundary map before the US midterm elections next year. Allegedly this is at the behest of President Trump.

The intention of the proposed changes is to push a number of Democrats out of office and strengthen the chances that the Republicans also keep their thin majority in Congress. They expect that the new maps could increase their seats by 5 congressional seats, up from 25 to 30 of 48 seats in Texas - all in areas that President Donald Trump won the most votes in last Novembers election by at least 10 points.

This and the other attempts in other states could or can of course, be challenged in the local state courts but no higher than that. However it appears that so far no local higher court in the states that have already undertaken these dubious redistricting exercises have blocked the new boundary and seats maps.

In fact, such is the fear in Texas that the local higher state court will not intervene, that the local House Democrats have fled the state in a bid to block the Republican effort to redraw congressional districts in the Republicans favour ... by not being there, they prevent a quorum, so changes would be void if voted through in their absence. However this is at best a delaying tactic and leaves those hiding liable to fines and censure.

Other Democrats in majority states such as California, Illinois, Maryland, New Jersey and New York have said that in light of the Texas redistricting they too will consider redrawing their own congressional district maps, to add more Democratic-leaning seats to counter the new Republican congressional seats in Texas ... "We are at war" said New York Gov. KathyHochul as a rallying cry to respond against the Texas move. Similarly, in return other Republican states such as Florida have also suggested doing the same as Texas.

So we now face the possibility of each US state becoming locked into virtual permanence as either Republican or Democrat within just a few years, as each ruling party redraws constituencies in their state in an extreme partisan manner, to ensure it is likely to win the majority in the mid-terms and beyond.

Oddly this wouldn't lock the Presidency up as votes are by state wide tally, but could lock the Congress i.e the Senate and the House of Representatives, into becoming near permanently either Democrat or Republican, with only very occasional swings sufficiently large to break the near permanent deadlock, or worse both of them being semi permanently held by just one party.

This would then be the end of the concept of 'free and fair elections' and could even paralyse the US government when an opposing party President was in power if both houses were from a different party ... Or worse aid an extremist President if he was from the same party as both the House and Senate and the Supreme Court ..... a bit like now really.

  1. The Democrats in Texas have returned claiming a victory of sorts because the publicity has raised Democrats awareness nationally of the gerrymandering.

    A number of Democrat states are now undertaking their own redistricting exercises to cancel out the Texas exercise. Meanwhile they intend to build a legal case to challenge the "racist" redistricting in Texas.

    Of course all these redistricting exercises are gerrymandering one way or another and will reinforce the party in power thus cementing the end of true democracy in the USA.

    A root and branch reform is what's needed but won't happen. At the very least redistricting should be done on a non partizan basis in every state.

    1. I agree that what's happening in the USA is looking increasingly disturbing. Its like two tribes have gone to war and no common values are shared anymore. When I was a teen and started following US politics in our press, the impression was that Republicans and Democrats largely shared a centre ground of values with just certain views differing off that centre.

      Now, 50 years or so later they seem to have diverged completely and barely see the country in the same way. A story breaking today illustrated this. Stone Bridge High School in Loudoun County, Virginia, allows students to use the toilets and changing rooms that fit their preferred sexuality rather than their biological sexuality.

      This prompted two boys to challenge and question a female student, who said she identified as a he, or as a male when the transgender student was in the boys locker room and allegedly filming/recording them (an illegal act in most circumstances). The boys were allegedly suspended from the school, and a row, divided largely along Democrat and Republican lines has broken out. Legal action and lawyers are already in action. A story that sums up the divided values in the US at the moment.

      NB: The story said that Loudoun County Public Schools has reportedly been subject to controversy on their trans-rights policies in the past, by spending vast sums on gender neutral toilets, and with one parent complaining about his daughter allegedly being sexually assaulted by a trans student in one of their schools, and being arrested for making the complaint.

  2. Texas has pushed through the changes to create 5 more Republican congressional seats. This has prompted a number of other states to follow suite across the two party divide.

    How this can be good for democracy in my country is something I can't understand.

  3. Anyone who doesn't conform to Donald Trumps opinion is now sacked. This is like a dictatorship in its response. For instance Gen Jeffery Kruse was sacked as head of US Defence Intelligence Agency (DIA), by the Pentagon, and two other senior military commanders have also been removed by the Pentagon.

    The reason, they gave a different assessment of the effects of the US attack on the Iranian nuclear site. Suggesting that it had done less damage than President Trump's total obliteration claims.

    Trump likes to shoot the messenger, and so there will soon only be one type of messenger - the Trump kind who only brings the news that he wants to hear.

    This is the same behaviour pattern that North Korean and Russian leaders follow. To be fair he stops short of killing them but destroying careers is life affecting for those he fires.

    1. Thanks for the comment Don. I am frankly at a loss as to what to say. The Trump presidency is rewriting the rules of presidential behaviour both internally and externally. I suspect that history may not look back kindly on these years, but I may be wrong.

      In the meantime China just grows more powerful, economically, politically and militarily and capitalising on the Trump chaos with its influence spreading across the pacific, and even claiming that its a 'near Artic' nation.

    3. Thanks for the comment. The apparent rejection of science based health policies, in favour of unproven claims linking vaccination to genetic disabilities such as autism should be alarming for US citizens.

      But its perhaps not surprising given Trumps fundamentalist Christian and anti-government background supporter base. In fact I suspect that they will soon ban Darwinism, and insist on Creationism being taught as fact in schools. The Handmaids Tale has never been closer ....

  4. In further reference to Dons comment ... Trump has now fired Fed governor Lisa Cook ... and action that may or may not be legal and never done by a previous US president.

    This is of course part of his ongoing campaign to remove or undermine the Fed Reserves chair Jerome Powell's reluctance to sut interest rates.

    Again this will go to the courts and is another attempt to extend presidential powers further than ever before.

Its a little odd that Trump wants to accumulate so much presidential power, given that he's only got 3yrs 2mths left in power ... so someone else will be wielding it .. possibly a vengeful Democrat if they ever get a credible champion who realises that the wind has changed on DEI policies.

    1. Yes the free use of fixing elections via redistricting seems to be in full flow in the USA. Sadly there seems to be no shock from the electorate at what is really a political scandal. Thanks for the comment.

  6. Fox News is very pro-Trump and so their stories are often framed through that lens. So reading the story on the link you have provided they are rather pleased with this development.

    I am not sure that my fellow citizens have really thought through what gerrymandering leads to. This is ironic as of course its an American term from Massachusetts when the practice was being practised in 1812.

    As there are no real prohibition against the practice its becoming more widely spread and soon every state will be defined by the practice thus locking each state into a particular bias when votes are cast and negating many opposition votes in many districts where voting will be a waste of time for many.
